Home Qualifiers — Partner Agreement
Effective Date: Date Partner Accepts Agreement
This Partner Agreement ("Agreement") is entered into between Home Qualifiers (a DBA of Altara Data LLC), a Delaware limited liability company ("Home Qualifiers," "we," "us," or "our"), and you ("Partner," "you," or "your") as of the date you accept this Agreement by clicking "I Agree" or by accessing the Partner Portal.
1. Partner Program Overview
1.1 Purpose
Home Qualifiers offers a free Partner Program that allows real estate agents, mortgage brokers, and other professionals to manage their credit-disqualified leads using our platform. Partners can invite clients to use Home Qualifiers services to improve their credit and prepare for mortgage approval.
1.2 No Commissions
This is a 100% free partnership. Home Qualifiers does not pay Partners any commission on customer subscriptions, and Partners do not owe Home Qualifiers any commission or fee on closed transactions. Partners retain 100% of their real estate or mortgage commissions.
1.3 How It Works
- Partner invites clients to Home Qualifiers via the Partner Portal
- Clients sign up and pay Home Qualifiers $49.99/month directly
- Partner monitors client progress via the Partner Portal
- When clients are approval-ready, Partner completes the transaction and earns their commission
2. Partner Portal Access
2.1 Portal Features
Upon approval as a Partner, you will receive access to the Partner Portal, which allows you to:
- Import leads via CSV upload
- Send email invitations to clients
- Copy and share your unique referral link
- Track client progress and credit improvement
- Set minimum credit score thresholds for approval notifications
- Configure commission projections based on your average commission per transaction
2.2 Lead Management
You are responsible for:
- Inviting clients to the platform
- Following up with clients who do not complete signup
- Converting leads into paying customers
- Managing all client communication related to signup
Home Qualifiers will provide tools to facilitate conversions, but it is not Home Qualifiers' responsibility to convert your leads into paying customers.
2.3 Marketing & Attribution
Clients invited by Partners will receive Home Qualifiers marketing communications. Home Qualifiers uses tracking technology (including cookies and attribution systems) to ensure that all client signups are properly attributed to the referring Partner, regardless of which marketing channel ultimately converts the client.
Even if a client signs up through Home Qualifiers' direct marketing efforts, the Partner who originally referred that client will receive full attribution and visibility in the Partner Portal.
3. Client Relationship & Ownership
3.1 Partner Owns the Relationship
Clients invited by Partners remain the Partner's clients. Home Qualifiers acknowledges that these are your leads, your deals, and your relationships.
3.2 Home Qualifiers' Role
Once a client signs up and pays the $49.99/month subscription, Home Qualifiers will:
- Provide customer support (onboarding, technical assistance, progress tracking)
- Manage the credit optimization process
- Notify Partners when clients reach approval-ready status
- Send marketing communications to facilitate conversion and engagement
3.3 Attribution Tracking
Home Qualifiers will track all Partner-referred clients using cookies and attribution technology. If a Partner-referred client converts through Home Qualifiers marketing (email, SMS, ads, etc.), that client will still be attributed to the Partner in the Partner Portal.
3.4 Client Payment
Clients are responsible for paying Home Qualifiers $49.99/month directly. Any arrangement between Partner and client regarding who pays the subscription fee is between Partner and client.
3.5 Termination of Partnership
If you terminate your Partner account, your referred clients will remain active Home Qualifiers customers until they cancel their own subscriptions. You retain full ownership and may instruct your clients to cancel if you choose to move to a different solution.
4. Mortgage Referrals (Optional)
4.1 Lexford Financial Partnership
Home Qualifiers has a partnership with Lexford Financial, a separate mortgage company. If a Partner does not have an existing mortgage partner, clients may be referred to Lexford for loan approval.
4.2 No Commission Split
Use of Lexford Financial is entirely optional. If a client is referred to Lexford:
- Lexford retains the mortgage commission
- The Partner (if a real estate agent) retains their real estate commission
- There is no commission split between Home Qualifiers and Lexford or Home Qualifiers and the Partner
This arrangement is identical to any standard real estate transaction where the mortgage broker and real estate agent operate independently.
4.3 Partner's Choice
Partners are free to refer clients to their own preferred mortgage lenders. Home Qualifiers does not require use of Lexford Financial.
5. Partner Responsibilities
5.1 Compliance
Partner agrees to:
- Promote Home Qualifiers in compliance with all applicable laws and regulations
- Provide accurate information about Home Qualifiers services
- Not engage in spam, false advertising, or misleading claims
- Not misrepresent Home Qualifiers' capabilities, guarantees, or results
5.2 Lead Conversion
Partner is solely responsible for:
- Converting invited leads into paying customers
- Following up with leads who do not complete signup
- Managing client expectations and communication
6. Home Qualifiers Responsibilities
6.1 Platform Access
Home Qualifiers will provide Partner with access to the Partner Portal and all related tools necessary to invite and manage clients.
6.2 Customer Support
Once a client signs up and pays, Home Qualifiers will:
- Provide onboarding support
- Manage the credit optimization process
- Offer technical support and progress tracking
- Send marketing communications to facilitate client engagement and conversion
- Notify Partner when clients reach approval-ready status
6.3 Attribution & Tracking
Home Qualifiers will maintain attribution tracking to ensure Partner-referred clients are properly credited to the Partner, even if those clients convert through Home Qualifiers' own marketing efforts.
7. Intellectual Property
7.1 Home Qualifiers IP
All intellectual property rights in the Home Qualifiers platform, Partner Portal, branding, and related materials remain the exclusive property of Home Qualifiers (a DBA of Altara Data LLC). Partner is granted a limited, non-exclusive, non-transferable license to use Home Qualifiers branding and marketing materials solely for the purpose of referring clients to the platform.
7.2 Partner Data
Partner retains all ownership rights to their client data. Home Qualifiers acknowledges that client lists, contact information, and relationship data belong to the Partner.
8. Confidentiality
8.1 Confidential Information
Each party agrees to keep confidential any proprietary or sensitive information disclosed by the other party, including but not limited to business strategies, client data, pricing information, and technical specifications.
8.2 Exceptions
Confidential Information does not include information that:
- Is publicly available
- Was known to the receiving party prior to disclosure
- Is independently developed by the receiving party
- Is required to be disclosed by law
9. Indemnification
9.1 Partner Indemnification
Partner agrees to indemnify, defend, and hold harmless Home Qualifiers (and Altara Data LLC) from any claims, damages, losses, or expenses (including legal fees) arising from:
- Partner's use of the Home Qualifiers platform
- Partner's marketing or promotional activities
- Partner's misrepresentation of Home Qualifiers services
- Partner's violation of applicable laws or regulations
- Any claims brought by Partner's clients based on Partner's actions or advice
9.2 Liability Disclaimer
Home Qualifiers assumes no liability for:
- Partner's communication with clients
- Partner's business practices or client management
- Any legal disputes between Partner and their clients
- Spam or unsolicited communications sent by Partner
10. Non-Disparagement
10.1 Mutual Non-Disparagement
Partner agrees not to make any statements, written or verbal, or cause or encourage others to make any statements that defame, disparage, or criticize the personal or business reputation, practices, or conduct of Home Qualifiers, Altara Data LLC, or their respective employees, directors, or officers.
Home Qualifiers agree not to make any statements, written or verbal, that defame, disparage, or criticize the personal or business reputation, practices, or conduct of Partner.
This non-disparagement clause applies during the term of this Agreement and survives termination.
11. Non-Compete
11.1 Exclusive Use
While participating in the Home Qualifiers Partner Program, Partner agrees not to simultaneously promote, partner with, or refer clients to any competing credit repair, credit optimization, or homeownership preparation platform.
11.2 Post-Termination
Upon termination of this Agreement, Partner is free to partner with or promote any service without restriction.
12. Term and Termination
12.1 Term
This Agreement begins on the date the Partner accepts it and continues until terminated by either party.
12.2 Termination by Partner
Partners may terminate this Agreement at any time by providing written notice to Home Qualifiers at support@homequalifiers.com. Upon termination:
- Partner's access to the Partner Portal will be revoked
- Partner-referred clients will remain active Home Qualifiers customers unless they cancel their own subscriptions
12.3 Termination by Home Qualifiers
Home Qualifiers may terminate this Agreement immediately if Partner:
- Violates any term of this Agreement
- Engages in fraudulent, deceptive, or illegal activity
- Misrepresents Home Qualifiers services
- Spams or engages in unethical marketing practices
- Fails to comply with applicable laws or regulations
12.4 Effect of Termination
Upon termination:
- Partner must cease all use of Home Qualifiers branding and marketing materials
- Partner must delete or return any confidential information provided by Home Qualifiers
- All client data and relationships remain the property of the Partner
- Partner-referred clients remain active customers until they cancel
13. Limitation of Liability
13.1 No Warranties
THE HOME QUALIFIERS PLATFORM AND PARTNER PORTAL ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
13.2 Limitation of Liability
IN NO EVENT WILL HOME QUALIFIERS (OR ALTARA DATA LLC) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST BUSINESS OPPORTUNITIES, OR LOSS OF DATA.
HOME QUALIFIERS' TOTAL LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED $500.
14. General Provisions
14.1 Governing Law
This Agreement is governed by the laws of the State of Delaware, without regard to conflict of law principles.
14.2 Entire Agreement
This Agreement, together with the Home Qualifiers Privacy Policy and Terms of Service, constitutes the entire agreement between the parties and supersedes all prior agreements or understandings.
14.3 Amendments
Home Qualifiers may update this Agreement at any time.
14.4 Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
14.5 Assignment
Partners may not assign this Agreement without Home Qualifiers' prior written consent. Home Qualifiers may assign this Agreement to any successor or affiliate.
14.6 Independent Contractors
Partner and Home Qualifiers are independent contractors. Nothing in this Agreement creates a partnership, joint venture, employment, or agency relationship.

Acceptance
By clicking "I Agree" or by accessing the Partner Portal, you acknowledge that you have read, understood, and agree to be bound by this Partner Agreement.
